Agreement to Our Legal Terms

PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY USING OUR SERVICES (AS DEFINED BELOW), YOU AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS ("TERMS OF SERVICE" OR "AGREEMENT"). IF YOU ARE ENTERING THIS AGREEMENT ON BEHALF OF AN ORGANIZATION, YOU CONFIRM THAT YOU HAVE THE AUTHORITY TO BIND THE ORGANIZATION, AND THAT THE ORGANIZATION WILL BE BOUND BY THESE TERMS. THE TERMS "YOU" OR "YOUR" SHALL REFER TO YOU AND SUCH ORGANIZATION (IF APPLICABLE).

We may update these Terms from time to time. The most current version will be posted on this page with the updated effective date. Continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.

Definitions

For the purposes of these Terms:

  • "Platform" refers to the Spiritual Gifts AI website, software, DISC and spiritual gifts assessments, and all related tools and services.
  • "Individual User" means a person using the platform for personal, non-commercial purposes.
  • "Church Account" means an organization using the platform to administer spiritual gift assessments.
  • "Services" refers to all tools, content, features, and functionality provided via the Platform.

Ownership

This service is owned and operated by Sermon Solutions LLC d/b/a Spiritual Gifts AI (referred to herein as "Spiritual Gifts AI," "we," "our," or "us"). Sermon Solutions retains ownership of all derivative works, improvements, or modifications to its intellectual property, regardless of their origin.

Our Services

Spiritual Gifts AI is a platform designed to help individuals discover their spiritual gifts and DISC personality profile, and for churches to administer assessments, manage data, and engage their members.

Individuals may use a free version of the platform to take personal assessments. Churches may subscribe to a paid version of the platform, which enables them to onboard their members, distribute assessments, and view results through a dedicated church dashboard.

The Services are not intended for use in jurisdictions where such use would violate local laws or regulations. Accessing the Services from outside the United States is done at your own risk, and you are responsible for compliance with applicable laws. The platform is not designed to meet industry-specific compliance standards (e.g., HIPAA, FISMA). Use of the platform in a way that would require such compliance is not permitted. You may not use the platform in any way that would violate the Gramm-Leach-Bliley Act (GLBA).

Intellectual Property Rights

Our Intellectual Property

Sermon Solutions retains full ownership of all intellectual property rights related to the platform, including but not limited to source code, software, content, design, trademarks, and documentation. These elements are provided "AS IS" for limited personal or organizational use as defined in your account type. You may not copy, reproduce, distribute, decompile, or reverse-engineer any part of the platform.

Your Use of Our Services

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services in accordance with these Terms. Use of the platform outside its intended purpose or beyond your access level (free or paid) is strictly prohibited.

User Types and Access

There are two primary user categories:

  • Individual Users: May use the platform for free, subject to functionality limits.
  • Church Accounts: May purchase a subscription to manage, distribute, and receive member assessments. Church accounts are responsible for ensuring appropriate use of data shared through their organization.

Purchases and Payments

Sermon Solutions accepts payments via major credit cards and third-party processors. All prices are listed in U.S. dollars and may change at any time. Subscription charges for church accounts will recur automatically unless canceled before the next billing cycle.

Free Trial

New church users may access a 7-day free trial of the full-featured version. After the trial period, the payment method on file will be charged unless the subscription is canceled before the end of the trial.

Cancellation

You may cancel your subscription at any time through your account settings. The cancellation will be effective at the end of your current billing cycle. All purchases are non-refundable. No prorated refunds will be issued for unused time or early cancellations. It is your responsibility to cancel before the next billing cycle if you no longer wish to use the service.

Prohibited Activities

You agree not to:

  • Use the Services for any illegal or unauthorized purpose.
  • Interfere with the normal operation of the platform.
  • Infringe upon our intellectual property or that of others.
  • Upload, post, or distribute harmful, obscene, or misleading content.
  • Use bots, scripts, or scraping tools to access or manipulate the platform.
  • Misrepresent your identity or use the platform in a deceptive way.

Violation of these restrictions may result in account termination and potential legal action.

AI and Automation Disclosure

Parts of the platform utilize artificial intelligence to deliver personalized content and recommendations. While we strive for accuracy, AI-generated content may occasionally contain inaccuracies or errors. You agree to use discretion when applying such content in ministry or decision-making contexts.

Spiritual and Personal Use Disclaimer

The Services are intended for spiritual growth, discipleship, personal development, and church engagement. They are not a substitute for professional counseling, therapy, or pastoral care. Spiritual Gifts AI does not guarantee any specific spiritual, emotional, or personal outcomes from use of the platform. Users are encouraged to seek guidance from qualified spiritual leaders or professionals for personal decisions.

Disclaimer

THE PLATFORM AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE PLATFORM WILL BE ERROR-FREE OR AVAILABLE AT ALL TIMES.

Limitation of Liability

To the fullest extent permitted by law, Sermon Solutions shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of the Services, including but not limited to loss of data, revenue, or interruption of service.

Governing Law

These Terms are governed by the laws of the State of Florida. You agree that any dispute arising from or related to the Services shall be governed by the laws of the State of Florida, USA, without regard to its conflict of laws rules, and that any legal action shall be filed and resolved in Lee County, Florida.
